Partbike's terms and conditions of sale

All orders for products on the site require prior consultation and acceptance of the general terms and conditions of sale. The validation click of the order and the checkbox of the general terms and conditions of sale imply full acceptance of these. This click is equivalent to a "digital signature." **Article 1: Object** The purpose of these general terms and conditions of sale is, on the one hand, to inform any potential buyer about the conditions and modalities under which the seller proceeds with the sale and delivery of the ordered products, and on the other hand, to define the rights and obligations of the parties in the context of the sale of products by the seller to the buyer, which apply, without restriction or reservation, to all sales by Partbike. The Buyer, having become aware of the products and their characteristics marketed by Partbike, has, under his sole responsibility and based on his pre-determined needs before any order, chosen the product(s) to be ordered. Furthermore, the Buyer, being the only one familiar with the equipment he uses, is the sole judge of the compatibility of the ordered parts with those used by him. It is the Buyer's sole responsibility, if he does not consider himself sufficiently competent, to seek advice. **3.2. Ordering and purchasing** Any order validated by the customer implies full and irrevocable acceptance of these General Terms and Conditions of Sale by the customer unless specific conditions expressly agreed in writing by the company Partbike. The buyer is presumed to be over 18 years old to place an order. No order cancellations by the customer will be accepted after the order has been validated and until it is received by the buyer, regardless of the reasons. **3.3. Rates** The payment currency is exclusively the euro. International exchange fees will not be borne by Partbike. Payments are made in cash. Accepted means of payment are: - Credit card - Paypal - Bank transfer The prices of our products are expressed in Euros (€), all taxes included (VAT), and excluding delivery and packaging costs. General rules** The delivery of products ordered by correspondence will be made to the address indicated by the customer during the order. Any possible delay will not give rise to damages, retention, or cancellation of the order by the Buyer. In case of abnormal delay, an email will be sent to you. In any case, and in accordance with the provisions of Article L 121.20.3 of the Consumer Code, the ordered products will be delivered within a maximum period of thirty days from the day following the day the Buyer placed his order, subject to full payment of the price. In the event of non-delivery at the end of this period, the Buyer will have the option to cancel his order. The amounts paid by the Buyer will then be refunded to him without delay, excluding any other compensation. **4.2. Delivery issues** The Buyer is required to check, in the presence of the postman or the delivery person, the condition of the packaging of the goods and its contents upon delivery. If the Buyer has any doubts of any kind about the condition or content of his package, he must: - Refuse the goods by immediately issuing a report of anomaly to the postman or the carrier - Report these incidents to Partbike by email at contact@partbike.fr, within 24 hours from the refusal of the goods by the Buyer, and expose the said complaints or reservations Failure to follow the procedure outlined above will result in no claim being accepted from the Buyer. **4.3. Quality or conformity issues** In the event of delivery of a product that does not correspond to the order (defective or non-compliant), the Buyer must, given the nature of certain products, make his claim within 24 hours from the date of receipt of the product. Claims must be addressed by email to contact@partbike.fr and must include: - Buyer's contact details - Invoice number - Product references - Reasons for the claim In the absence of the procedure outlined above, PARTBIKE will not proceed with any exchange of the products ordered in this way. Any product to be exchanged must be returned to Partbike unused, undamaged, unsoiled, unopened, and undismantled. It must be returned in its original packaging, accompanied by its invoice and the return authorization number, previously requested, written on the packaging and include the entire product and its accessories. Products returned by the Buyer must be returned within seven working days from the agreement obtained by PARTBIKE. Shipping costs are the responsibility of the buyer. All risks related to the return of the product are the responsibility of the Buyer. Failure to follow the procedure outlined above and the indicated deadlines will prevent the Buyer from making any claims for non-compliance or apparent defects in the delivered products, the Products being then deemed to be compliant and free from any apparent defect. **4.4. General refund conditions** Any refund to be borne by Partbike will be made by the customer's initial means of payment. **Article 5: Warranty for hidden defects** Under the warranty for hidden defects, Partbike will only be liable for the replacement, free of charge, of the items concerned, without the customer being able to claim damages against Partbike. Partbike cannot be considered by the Buyer as responsible for any harmful consequences that these hidden defects may have caused. In any case, the warranties do not cover defects and deteriorations that have occurred and their consequences due to: - Abnormal and non-compliant use of the products - An accident - The intervention of the Buyer or an unqualified repairer - Non-compliant use for the purpose for which the product is intended (professional use, competition) **Article 6: Liability** Partbike cannot be held responsible for the non-performance of the contract in the event of stock shortage or unavailability of the product, force majeure, total or partial disruption, in particular of postal services and means of transport and/or communications. The products are under the full responsibility of Partbike until they are shipped to the carrier. Thus, Partbike cannot be held responsible for any breakages, losses, or thefts after the departure of the package(s) from the storage location. The transfer of responsibilities to the customer takes place upon receipt of the products and acceptance by the carrier. The products sold by Partbike can only be mounted on vehicles or systems recommended by the manufacturer, the equipment manufacturer, by a competent person and under his sole responsibility. Partbike is in no way responsible for the consequences of improper assembly or the use of an unsuitable product on a vehicle. Partbike cannot be held responsible for any indirect damages that may arise from the purchase of the products. **Article 7: Non-homologated articles** In France: The use of non-homologated products, especially exhaust pipes, is reserved for competitions whose regulations usually allow it. It is excluded to use them on public roads. The buyer of non-homologated products cannot in any case contest not having been informed of the non-homologation of the product sold. Any modification of the vehicle's characteristics compared to its homologation in French territory makes it unfit for circulation. Abroad: Unable to know the legislation of each country to which products, not homologated in France, could be sent, Partbike disclaims any responsibility towards these articles. Any customer, by making a purchase on our site, acknowledges having read the regulations of his country and therefore accepts to receive a non-homologated product in his country at his own risk. **Article 8: Partial invalidity** If one or more stipulations of these general terms and conditions of sale are held to be invalid or declared as such in application of a law, a regulation, or following a final decision of a competent jurisdiction, the other stipulations will retain their full force and scope. **Article 9: Non-waiver** The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations set out in these general terms and conditions of sale shall not be interpreted for the future as a waiver of the obligation in question. **Article 10: Applicable law** The sales of Partbike products are subject to French law. **Article 11: Data Protection** The information collected by Partbike during any order by the Buyer is necessary for the management of his order by Partbike.
